1. Acceptance of these terms

These Terms of Use ("Terms") govern your use of the VoiceMagic iOS application (the "App"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

The App is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms supplement the Standard EULA. If there is a conflict, the Standard EULA prevails to the extent required.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and permission of a parent or legal guardian.

3. Entertainment only

All features of the App are intended for entertainment.

• Lie Detector. The fingerprint scan, heart-rate line and results are animations. Results are generated randomly and do not measure truthfulness, emotions or any physical signal. Never use them to make real decisions about people, relationships, employment or any other matter.
• Character voices and voice effects. Generated voices are fictional characters and are not intended to sound like any real person.
• Prank sounds. Sounds such as weapons, explosions or alarms are fictional sound effects for harmless jokes.

4. Acceptable use

You agree not to use the App or anything you create with it to:

• harass, bully, threaten, frighten or intimidate anyone, or cause panic (for example by playing weapon or explosion sounds in public places, schools, transport, or near police or security personnel);
• impersonate a real person or organization, or deceive anyone for fraud, scams or financial gain;
• record or share another person's voice without the consent required by the laws where you live;
• create or share content that is unlawful, defamatory, hateful, sexually explicit, or that infringes anyone's intellectual property or privacy;
• disturb people who could be harmed by a sudden loud sound, such as young children, the elderly, people with heart conditions, or animals;
• reverse engineer, decompile, modify, or misuse the App or the services it connects to, except where this restriction is prohibited by law.

Please prank kindly. Make sure everyone can laugh about it afterwards, and stop if someone is upset.

5. Your content

Text you enter, recordings you make and audio you create ("Your Content") belong to you. Your Content is stored on your device and you are solely responsible for it, including how you share it. We do not claim ownership of Your Content and do not receive a copy of it. You grant us no license to Your Content other than what is needed for the App to process it on your behalf, such as sending your text to our text-to-speech provider to generate audio.

6. Our content

The App, including its design, characters, artwork, mascot, sound effects and software, is owned by us or our licensors and is protected by intellectual property laws. You may share audio you create with the App for personal, non-commercial purposes. You may not extract, resell or redistribute the App's built-in sound effects, characters or artwork on their own.

7. Third-party services

Some features rely on third-party services, including Baidu AI Cloud for text-to-speech and Apple for speech recognition, sharing and ratings. These services are provided by their respective owners under their own terms, and we are not responsible for their availability, accuracy or conduct. Features that depend on them may require an internet connection and may change or stop working if the service changes.

8. Availability and changes

We may update, change, suspend or discontinue any part of the App at any time, including adding or removing characters, effects or sounds. We will try to keep the App working well, but we do not guarantee that it will always be available, uninterrupted or error-free.

9. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, goodwill or profits, arising from your use of, or inability to use, the App, or from any content you create or share or any prank you carry out. Our total liability for any claim relating to the App will not exceed the amount you paid for the App (if any). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnity

You agree to indemnify and hold us harmless from any claims, damages or expenses (including reasonable legal fees) arising from your misuse of the App, Your Content, or your breach of these Terms or of any law or third-party right.

12. Termination

You may stop using the App at any time by deleting it. Your right to use the App ends automatically if you breach these Terms.

13. Changes to these terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. By continuing to use the App after changes take effect, you agree to the revised Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which the App's developer is established, without regard to conflict-of-law rules, except where the consumer protection laws of your country of residence give you the right to rely on local law.

15. Apple-specific terms

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for addressing any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
